By accessing this Site, you agree to the Terms and Conditions under which you may use this Site and enter into transactions with us (“the Terms”). Your access is subject to acceptance of and compliance with the Terms. If you disagree with the Terms, do not use this Site and our services. The following terms and conditions apply to bookings carried out by TROPIC TOURS and are subject to vary in the booking confirmation issued by TROPIC TOURS. We accept no responsibility for the information supplied to us by third parties. We suggest you confirm all information contained or linked from the Site with the relevant third-party provider.
1. The traveller and Tropic Tours agree that:
1.1 A binding tour contract incorporating these terms and conditions will be formed when Tour Tropic confirms the traveller’s booking, which it will do on receipt of the pre-payment or the tour cost (as the case may be);
1.2 Full payment of the tour price is required upon making the booking of the tour unless otherwise specified;
1.3 A minimum of 4 travellers is required for a Small Group shared tour to operate. Tropic Tours may cancel a tour if that minimum number is not met or allocate a day on either side of the requested date to commence the tour.
1.4 An Exclusive Tour is a booking made for 2 or 4 people travelling together on a private non-shared tour.
1.5 Where possible, Tropic Tours will accommodate a single traveller by joining them on a Small Group tour.
1.6 A single traveller may book an Exclusive Tour if a vehicle is available, and Tropic Tours will determine the price at the time of booking.
1.7 Tropic Tours reserves the right to notify the traveller of alterations, amendments, and cancellations to the tour under these terms and conditions;
1.8 Travellers are bound by these terms and conditions by the booking in their own right or having a booking made on their behalf by another person from the time of booking.
1.9 A paying passenger is a child classed as 0-12 years and an adult aged 13 years and up.
2. THE TRAVELER’S RESPONSIBILITIES WHEN MAKING A BOOKING:
2.1 Accepts the physical risks involved in the tour;
2.2 Must not commence the tour if they are unfit or become unfit to participate in the tour because of ill health or injury;
2.3 Is responsible for the safekeeping against loss and protection against damage of all personal effects of the traveller.
2.4 Must take out travel insurance covering tour cancellations, inability to travel or continue with the tour (for whatever reason), loss or damage to personal effects, medical, evacuation, and repatriation expenses, and accidental death or disability;
2.5 Selects appropriate clothing, including-walking shoes suitable for uneven terrain, appropriate clothing for sun protection and bushwalking, sunscreen, a hat, and a water bottle.
3. TROPIC TOURS RESPONSIBILITIES:
In accepting a tour booking, Tropic Tours agrees:
3.1 That the traveller’s pre-payment will be held in trust until after the travel service has been provided;
3.2 To maintain liability and indemnity insurance to cover the liabilities of travellers (however, travellers are responsible for relying upon their travel insurance in almost all instances where injury, loss, or damage is suffered to themselves or their effects);
3.3 To maintain licences and permits necessary to carry out travel arrangements;
3.4 To ensure personalised service on shared tours by having a maximum ratio of one guide per 12 travellers;
4. CANCELLATION POLICY
For cancellations made to an Exclusive Private Tour or A small group tour, the following cancellation fees will apply:
4.1 Cancellations received more than 30 days before the booked tour date – 20% Administration fee applicable and the balance refunded.
4.2 Cancellations received up to and less than 7 days but more than 48 hours before the booked tour date – 50% fee applicable and the balance refunded.
4.3 Cancellations received less than 48 hours or for non-appearance to commence the tour – all monies will be forfeited
5. FORCE MAJEURE
Force Majeure means (without restriction) any event that Tropic Tours could not, even with due care, foresee or avoid. Force Majeure covers events such as, but not limited to, adverse weather conditions, fire, floods, and all similar events beyond our control. In the case of Force Majeure, Tropic Tours will not accept liability and reserves the right to change and cancel trips.
If a Force Majeure circumstance necessitates the cancellation of the tour, then:
5.1 The traveller must rely upon any travel insurance they hold for compensation; and
5.2 Where possible, Tropic Tours will substitute an itinerary with similar experiences.
6. LIABILITY, RESPONSIBILITY, LIMITATION, AND JURISDICTION
6.1 Tropic Tours is not responsible for the actions, defaults, or negligence of any third party travel providers, venues, or attractions it engages for the tour, except where the loss or damage arises from a specific direction given by Tropic Tours to those providers.
6.2 Integrated Sites- The Site www.tropictours.com.au integrates with the third-party online sites Respax and Eway. These sites are for managing reservations and for receiving payments, information collected including personal identification and credit card details will be used to book tours with Tropic Tours only.
6.2.1 Links from Tropic Tours site to third-party sites shall not be construed as any approval, referral, recommendation, or endorsement by Tropic Tours of the owners of the third-party sites or for any information, goods or services referred to or offered on the third-party sites unless expressly indicated on this Site.
6.2.2. Tropic Tours makes no warranties and accepts no liability concerning any information contained on any third-party sites nor for its privacy and security terms.
6.2.3 Travelers are responsible for making online reservations and accepting the terms and conditions of payments made through the specified gateway payment provider.
6.3 The traveller is responsible for all loss or damage arising from his or her fault.
6.4 Tropic Tours will not be liable for any illness, injury, or death sustained on tour because of the traveller’s medical condition.
6.5 Tropic Tours will not be responsible for, and the traveller will release Tropic Tours from any liability arising from any medical condition suffered by the traveller during the tour or as a consequence of the tour.
6.6 The traveller indemnifies and holds no accountability to Tropic Tours and its officers, employees, and suppliers against all actions, proceedings, claims, demands, expenses and costs, including legal costs, on a full indemnity basis. This included if incurred or awarded against Tropic Tours as a result of, or arising to, whether directly or indirectly, the traveller booking or participating in the tour or any act or omission by the traveller concerning the tour.
6.7 To the maximum extent permitted by law, all implied conditions and warranties regarding the provision of services by Tropic Tours under these terms and conditions are excluded. Tropic Tours, in relation to any non-excluded conditions or warranties, is limited to Tropic Tours either delivering the services again or paying the cost of providing similar services again. In any event, Tropic Tours’ total liability under this Agreement (including for loss or damage to baggage, compensation for distress, disappointment and loss of enjoyment) will be limited to the amount of the tour price only paid by the traveller to Tropic Tours.
6.8 To the maximum extent permitted by applicable law, Tropic Tours excludes, and the traveller releases Tropic Tours from all other liability, including without limitation any consequential or special damages or costs arising directly or indirectly from or in relation to the services provided in accordance with these terms and conditions.
6.9 Any booking shall be subject to and construed in accordance with Queensland laws in force, and the parties agree to submit to the jurisdiction of the courts in Queensland.
7. Personally Identifiable Information
7.1 Refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains, including, but not limited to, name, address, phone number and email address.
7.2 Tropic Tours, for marketing reasons, may collect basic profile information from all our Visitors. The information collected from our authorised customers: names, addresses, phone numbers, emails and general demographics. Profile information provides ongoing communications from Tropic Tours and will not be shared or sold to any third-party company.
